Il settore minerario è stato per decenni un settore centrale della produzione italiana essenziale a garantire il fabbisogno di molte materie prime indispensabili per le industrie Da anni tuttavia tale settore è entrato in uno stato di dismissione generalizzato anche a fronte di una situazione geopolitica che richiederebbe di tornare ad incentivare le produzioni nazionali In questo articolo si indaga se tale processo sia causato anche dalla struttura normativa che regola il funzionamento del settore minerario Lanalisi prenderà in considerazione anche la struttura legale esistente in Germania e Regno Unito al fine di valutare se diverse normative possano condurre a risultati diversi Infine si approfondiranno gli ultimi interventi del legislatore in materia cercando di capire se tale settore possa essere riformato in modo da tornare ad essere competitivo

The mining sector has been a central sector of Italian production for decades essential to guarantee the need for many raw materials essential for industries For years however this sector has entered a state of generalized decommissioning also in the face of a geopolitical situation that would require a return to incentivizing national production This article investigates whether this process is also caused by the regulatory structure that governs the functioning of the mining sector The analysis will also take into consideration the existing legal structure in Germany and the United Kingdom in order to assess whether different regulations can lead to different results Finally the latest interventions of the legislator in this area will be explored trying to understand whether this sector can be reformed in order to return to being competitive
