Con l’ordinanza numero 16691/2020 la prima sezione civile della Corte Suprema di Cassazione ha affermato che “laddove la ragione dell’addebito sia costituita dall’inosservanza dell’obbligo di fedeltà coniugale, questo comportamento, se provato, fa presumere che abbia reso la convivenza intollerabile” . Sostanzialmente tollerare un partner fedifrago preclude la separazione con addebito, se si è continuati a convivere come se nulla fosse accaduto.

With the order number 16691/2020 the first civil section of the Supreme Court of Cassation stated that "where the reason for the charge is constituted by the non-observance of the obligation of marital fidelity, this behavior, if proven, leads to the presumption that the intolerable coexistence ".
