Il presente contributo si propone di analizzare i profili più significativi della responsabilità del datore di lavoro intesa quale obbligo di apprestare tutte le misure, nominate e innominate, necessarie a garantire la tutela della salute psico-fisica del lavoratore ai sensi dell’art. 2087 c.c., con approfondimento dei i temi che hanno formato oggetto di copiosa attività giurisprudenziale e una riflessione finale circa la posizione di garanzia del datore di lavoro e la correlativa esigenza di tutela del lavoratore nell’ambito del settore dei trasporti, che oggi rientra certamente tra quelli ritenuti maggiormente pericolosi e soggetti a rischi.

The purpose of this contribution is to analyze the most significant profiles of the employer s responsibility as an obligation to provide all the measures, named and unnamed, necessary to guarantee the protection of the psycho-physical health of the worker pursuant to art. 2087 Civil Code, with an in-depth examination of the themes that have been the object of copious jurisprudential activity and a final reflection on the position of guarantee of the employer and the correlative need of the worker in the transport sector, which today is certainly among those considered most dangerous and subject to risk.
