Il commercio internazionale affonda le sue radici nella storia. In un primo momento, gli attori commerciali facevano affari scambiando merci durante le grandi fiere che si svolgevano nell’età di mezzo. Attraverso queste grandi fiere, i mercanti di tutto il mondo si incontravano per scambiarsi oro, spezie, seta e altri prodotti pregiati. Lungo la strada che collegava l’Oriente all’Occidente, passando per il Medio Oriente, gli affari erano fiorenti. Nel 2012, il presidente cinese Xi Xinping ha dichiarato il ripristino delle antiche vie della seta, attraverso le quali la Cina avrebbe sviluppato il suo business e la sua influenza sui paesi vicini e sui partner occidentali. L’idea centrale rimane quella di creare, attraverso queste nuove vie, un ambiente favorevole per facilitare le relazioni commerciali. Quale fattore essenziale per favorire la fiducia delle parti straniere nel fare affari con la Cina, il modo principale per risolvere le controversie non è cambiato. Il meccanismo alternativo di risoluzione delle controversie consiste nel trovare il metodo più adatto per risolvere le controversie tra le parti, pur permettendo loro di mantenere buone relazioni. Questo articolo si concentrerà sull’ADR sulla Belt and Road Initiative lanciata dalla Cina, per evidenziare il ruolo svolto dal governo cinese nella creazione di un nuovo tribunale dedicato allo scopo e l’adattamento dell’organizzazione tradizionale che fornisce servizi ADR al fine di fornire un servizio completo alle parti che fanno affari nella BRI.

International trade takes its roots from history. At early ages, business actors made business in exchanging goods during big fairs took place in the middle age. Through these huge fairs, business around the world met each other to buy gold, spices, silk and other fine products. Along the road connecting East to West, via the Middle East, business was flourishing. In 2012, Chinese President Xi Xinping declared the re-establishment of the former Silk Roads, through the China would develop its business and its influence on neighboring countries and western partners. Through these new ways, core idea remains to create a favorable environment to facilitate business relationship. As essential factor to facilitate confidence for foreign parties to make business with China, the main way to resolve disputes did not change. Alternative dispute mechanism consists of finding the more suitable mechanism for solving dispute between the parties while letting them pursing their good relations. This paper will focus on the ADR along the Belt and Road Initiative launch by China, to highlight the role played by Chinese government in setting up a new court dedicated to this, and the adaption of traditional organization providing ADR services in purpose to provide a complete service to parties making business in BRI.
